1. General conditions of sale
1.1 LABORATORY offers the products for sale on the Site to final consumers, i.e. to subjects who purchase for purposes not related to their commercial, entrepreneurial or professional activity, possibly carried out (the "Customer"). LABORATORIO therefore reserves the right not to process orders from subjects other than the "consumer" or in any case to orders that do not comply with its commercial policy.
1.2 The contract stipulated between LABORATORY (hereinafter also the "Seller") and the Customer must be considered concluded with the acceptance of the order by LABORATORY. In the event of non-acceptance of the order, LABORATORY will in any case promptly notify the Customer.
1.3 By placing an order in the manner provided, according to the path indicated on the site, the Customer declares to have read all the information provided to him during the purchase procedure and to fully accept these general conditions of sale.
1.4 These Conditions may be printed or saved on a durable medium, in compliance with the provisions of art. 12 of Legislative Decree 70/2003 and by art. 51 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.
2. Method of purchase
2.1 The products offered for sale by LABORATORY are only those present on the Site at the time the Order is placed, as described in the relative information sheets, however LABORATORY reserves the right to evaluate and update the actual availability of the items and the description of the items themselves.
2.2 In any case, it is understood that the images accompanying the description of a product are for informational purposes only and may not be perfectly representative of its characteristics but may differ, e.g. by color and size (also due to the browser and monitor used to access the site and view the images).
2.3 To place an order, the Customer must fill in the fields on the Site and send the same, following the instructions on the Site, after having carefully viewed the Conditions, as well as the characteristics of the product and/or products he intends to purchase, the price ( inclusive of all applicable taxes or duties) and shipping costs.
2.4 Correct receipt of the Order is confirmed by LABORATORY by means of an e-mail reply, sent to the e-mail address communicated by the Customer. The latter is required to verify the summarized purchase conditions, as well as the data entered in the order by the Customer, immediately communicating any incorrect data.
2.5 If the chosen item is not actually available in the warehouse, even in the face of an indication of availability on the Site, LABORATORY reserves the right to cancel the purchase and refund the full amount within 7 days, crediting the balance by the same method in which the payment was made.
3. Prices and methods of payment accepted
3.1 The prices indicated on the Site are always to be considered inclusive of VAT. Any shipping costs or payment costs are in any case communicated in advance to the Customer through the Site during the completion of the purchase.
3.2 Product prices may be subject to updates with immediate effect. The customer is required to ascertain the final sale price before submitting the relevant order form.
3.3 Purchases can be made in the following ways:
• with credit card
• via PayPal
• in installments: with the Klarma platform.
3.4 The transaction will take place through a secure server chosen by LABORATORY Under no circumstances and at any stage of the payment will LABORATORY be able to know the information relating to the Customer's credit card, transmitted via secure connection directly to the website of the bank which manages the transaction. LABORATORIO will not keep any computer archive of such data and therefore in no case will LABORATORIO be held responsible for any fraudulent or illegal use of credit cards by third parties at the time of payment.
3.6 The contract is conditional upon the payment of the total amount due.
4. Delivery of items and related costs
4.1 The purchased items will be delivered to the address indicated by the Customer in the order by LABORATORY and its logistics service providers, at the cost expressly indicated at the conclusion of the purchase.
4.2 For deliveries requested in countries outside the European Union, any import customs fees will be charged to the Customer upon indication of the cost to LABORATORY. The Customer is therefore invited to contact the customs authorities of his country in advance to check the costs and any import limits.
4.3 The delivery times indicated by LABORATORY must be considered as purely indicative and a delay with respect to the same cannot be attributed to LABORATORY nor legitimize the Customer to refuse the delivery itself and to request compensation.
4.4 Upon delivery of the products, the Customer is required to verify that the packaging is intact, not damaged, wet or otherwise altered, even in the sealing materials, and, if not, to immediately report the findings, affixing a specific indication on the delivery document of the product to be returned to the courier.
4.5 Any lack of conformity of the products received must be reported by the Customer within two months of delivery or discovery, if later, and in this case the guarantee referred to in article 8 below will apply.
5. Size change
5.1 It is possible to exchange the article only for a different size or a different color of the same article, if available. It is not possible to exchange the garment for a different article.
5.2 If the item is not available in the requested size, the Customer can opt for a full refund or for a voucher that can be used for a subsequent purchase.
5.3 The change of size is to be requested through the specific RETURNS section or by contacting the customer care via email indicating the requested size.
5.4 There is only one free exchange of goods for each authorized return.
6. Right of withdrawal
6.1 The Customer may withdraw from the purchase contract for any reason, without the need to provide reasons and without any penalty, within 14 (fourteen) days from the date of delivery of the products using the appropriate "RETURNS" section (or by contacting the CUSTOMER care) present on the site, following the indicated procedure.
6.2 In case of withdrawal, the Customer must return the products to the LABORATORY within 14 (fourteen) days of the same withdrawal, according to one of the following methods, chosen by the Customer:
6.2.1 In all other cases, the costs for returning the product will be charged to the customer
6.3 The goods must be returned complete in all their parts, intact, having been used with normal diligence and eventually worn only for the time strictly necessary to establish and verify their nature, characteristics and size, with no signs of wear or dirt
6.4 The right of withdrawal may apply to the product purchased in its entirety; in fact, it is not possible to exercise withdrawal only on part of the product purchased (e.g.: accessories, complements, etc.);
6.5 For the withdrawal to be possible, the product must be complete in all its parts (including the supply of labels, tags)
6.6 The shipment, until the certificate of receipt in the warehouse indicated by LABORATORY, will be under the complete responsibility of LABORATORY in case of return due to defects. In all other cases, the return will be charged to the Customer and therefore LABORATORY will not be liable in any way for damage, theft or loss occurring during shipment.
6.7 Once the articles have been received, the LABORATORY carries out the necessary checks relating to the conformity of the same on the basis of the terms set out above. In the event that the checks do not give positive results and discrepancies with respect to what was declared are found, the Seller will notify the Customer, via e-mail, of the found existence of a decrease in value of the returned products, deriving from failure to comply with the conditions mentioned above. At the same time LABORATORY will communicate the amount that will be deducted from the refund, without prejudice, alternatively, to the possibility for the Customer to get back, at his own expense, the products in the state in which they were returned to LABORATORY
6.8 If the return checks give a positive result, LABORATORY will offer the customer the possibility to choose between a refund or a voucher equal to the value of the returned item, valued at the time of purchase. In the event of a refund, LABORATORY will refund the Customer the amount paid for the returned item, net of the shipping cost (except in the cases referred to in paragraph 6.2.1), within 14 (fourteen) days of receipt of the returned item, by transferring the charged amount and using the same means of payment used by the Customer for the initial transaction. In case of choosing a voucher, please refer to chapter 7.
6.9 If the terms of the right of withdrawal have expired, LABORATORY reserves the right not to accept the return and the refund request; beyond the terms of 14 (fourteen) days LABORATORY will be able to issue a value voucher ready for use on the next purchase in lieu of the full refund. 7.1 All items sold by the Seller are covered by the legal guarantee of 24 (twenty-four) months for lack of conformity, in accordance with applicable law. The lack of conformity can be communicated to the Seller by contacting Customer Service, which will evaluate the defect and any non-compliance. In the event of a lack of conformity, the Customer has the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or excessively burdensome, the Customer will be entitled to a reduction of the price paid or to the termination of the sales contract, pursuant to art. 130 of the Consumer Code

9.1 The personal data collected with the forwarding of the Order will be treated in order to satisfy the express requests of the Customer, in compliance with Legislative Decree 196/2003 as amended and supplemented by Legislative Decree no. 101 / 2018 which dictates provisions for the adaptation of national legislation to the provisions of EU Regulation no. 679/2016. Any further treatments will be carried out only with the express consent of the customer.
10. Governing Law
10.1 The sales contract referred to in these Conditions and its execution are governed by Italian law. Without prejudice to the application to Customers who do not have their habitual residence in Italy of any more favorable and mandatory provisions provided for by the law of the country in which they have their habitual residence. Please note that in the case of a Consumer Customer, the court of the place where the customer resides or has elected domicile is competent for any dispute relating to the application, execution and interpretation of the general conditions of sale or the contract.
10.2 In the event of disputes arising from the Conditions, the online Alternative Dispute Resolution body of the Milan Chamber of Commerce may also be consulted in advance.
10.3 Finally, we inform you that the European Commission provides a platform for the alternative out-of-court resolution of disputes, including cross-border disputes, accessible on the website http://ec.europa.eu/odr.
